Please read this page carefully before ordering services from us and understand what it says. It's a binding contract between Black Lion Apps, LLC™ and you.
Black Lion Apps, LLC™ ("Business Cards Augmented℠" or "BCAUG.com℠" or "us" or "we" or "our") provides its service (as defined below) to you ("you" or "client") through its web sites located at www.bcaug.com, www.businesscardsaugmented.com, and www.blacklionapps.com, subject to this Terms of Service agreement ("TOS"). By accepting this TOS or accessing or using the Service or site, you acknowledge that you have read, understood, and agreed to be bound by this TOS when on the Black Lion Apps, LLC™ site. Each Site that we maintain has its own TOS . If you are entering into this TOS on behalf of a company, business, or other legal entity; in that case, you represent that you have the authority to bind such entity and its affiliates to this TOS, in which case the terms "you" or "your" or "client" shall refer to such entity and its affiliates. If you do not have such authority, or if you disagree with this TOS, you must not accept this TOS and may not use the Service. The Business Cards Augmented℠ app is a free reader and displayer of information contained on the bcaug.net Network. Black Lion Apps, LLC™ maintains the Business Cards Augmented℠ app, and the BCAUG Network℠ that transmits the Augmented Business Card Data.
We will attempt to provide the service 24 hours a day, seven days a week. Sometimes, however, for some reasons, the services may be unavailable to you. You must recognize and acknowledge that occasional service unavailability cannot be avoided due to data-information hosting technology's nature. We have not promised to provide you with uninterrupted service. Sometimes there are equipment malfunctions. At other times we undertake periodic maintenance procedures or repairs. Still other times, there are causes beyond our control like power failures, interruption or failure of telecommunication or digital transmission links, hostile network attacks, network traffic, natural disasters, and other occurrences.
Black Lion Apps, LLC™ Free Technical Support is limited to issues directly related to the apps we create, and the networks we maintain. Black Lion Apps, LLC™ does not provide mobile or desktop maintenance services. Without limiting this exclusion, you also agree that Black Lion Apps, LLC™ accepts no responsibility for any deficiency or inaccuracy of the displayed Augmented Business Card attributable to defects in the cardholder entering their data. Or due to errors or mistakes in development /coding/ programming caused by our or a third parties API.
You further acknowledge that Black Lion Apps, LLC™ Technical Support does not include the maintenance of other direct or indirect issues/problems (but not limited to) such as browser version conflicts in HTML coding, Website Programming, Content/Data Migration, Uploading or Downloading of files.
During National Holidays and some occasional Local Holidays, our technical support will be limited. During this time, we will still be able to support you via email.
When you register any of the apps we make with us we collect the following information:
We take your privacy very seriously. As such, we will not sell your personal information to a third party (other than a company that may purchase Business Cards Augmented℠) and will take reasonable steps to keep it from being disclosed to any third party. Read more in our Privacy Policy.
Due to our evolving business, and the changing nature of data-information hosting technology's industry, these terms of service may change. We will post the changes here, and your continued use of the service means you accept the changes we have made.
If Black Lion Apps, LLC™ is sued or threatened with a lawsuit from a third party because of something you do with the service or site, you agree to pick up the tab if Black Lion Apps, LLC™ is found liable or pays to settle the dispute. In legal terms, this is called "indemnification" Not only do you agree to reimburse Black Lion Apps, LLC™ for what it pays to satisfy a judgment or settle a case, but you also agree to pay Black Lion Apps, LLC™ reasonable attorney's fees and all other costs Black Lion Apps, LLC™ incurs in defending itself.
Disclaimer of Warranties
BLACK LION APPS, LLC EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. BLACK LION APPS, LLC MAKES NO WARRANTY ITS SERVICES WILL MEET YOUR REQUIREMENTS, OR THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED. BLACK LION APPS, LLC DOES NOT WARRANT, NOR MAKE ANY REPRESENTATIONS REGARDING THE USE, OR RESULTS OF, ANY OF THE SERVICES IT PROVIDES, IN TERMS OF THEIR CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE. Some jurisdictions do not allow the disclaimer of implied warranties, in which event the preceding disclaimer may not apply to you.
The United States laws will govern this Agreement, without reference to rules governing choice of laws. Any action relating to this Agreement must be brought in the court located in White Plains, NY, U.S.A., when these terms take effect.
This agreement becomes effective once you submit your order with us or open an account with us for website services of any kind. If you are an existing customer and do not agree with the terms herein, please cancel your account. Otherwise, if you sign up for or continue to use the services, you agree to what is written here.
